Title: Establishes a Registration System for Employers Hiring Minors

Vote to pass a bill that establishes a registration system for employers hiring children and modifies child labor laws in Michigan.

Highlights:

  • Prohibits beginning 18 months after the passage of this bill minors under 18 from being employed in any occupation regulated under this legislation unless all of the following conditions are met, including (Sec. 2-20):

    • The minor is registered with the Department of Labor and Economic Opportunity;

    • The individual proposing to employ the minor complies with this bill; and

    • The individual proposing to employ the minor receives authorization from the department.

  • Authorizes the following exemptions for an employer registering a minor employee, including (Sec. 2):

    • The minor begins employment with a different employer;

    • The primary location at which the minor works changes; or

    • The minor turns 16 years of age.

  • Requires minors under 16 only be employed as follows (Sec. 2):

    • During a time that is outside school hours for no longer than 3 hours per day during the school year;

    • Between the hours of 7:00 AM and 9:00 PM during the period beginning on June 1, and ending on Labor Day;

    • Between the hours of 7:00 AM and 7:00 PM during the period beginning on Labor Day and ending May 31;

    • For no more than 18 hours per week when school is in session and increased to 40 hours when school is not in session.

  • Requires the Director of the Department of Labor and Economic Opportunity to create and maintain a registration system that does the following, including (Sec. 10):

    • Allows a minor to register for employment or a parent or legal guardian of a minor to register the minor for employment;

    • Allows an employer to register to employ minors under this act as described;

    • Be accessible to the public via the Internet at no cost to the public;

    • Require a minor or a parent or legal guardian of a minor to submit information that is sufficient, as determined by the department, to identify all of the following:

      • The name and age of the minor;

      • The minor's home address and contact information;

      • The name of each of the parents or legal guardians of the minor; and

      • The home address and contact information of each of the parents or legal guardians of the minor.

    • Allow a minor or a parent or legal guardian of a minor to describe a physical limitation of the minor;

    • Allow a minor, parent or legal guardian of a minor, or an employer to review an applicable determination;

    • Allow an employer to submit the information and items described

    • Provide automatic notification to an employer when a minor registers for employment with the employer; and

    • Any other requirement that is relevant to the employment of a minor under this act as determined by the director.

  • Prohibits the director from granting any deviations to the aforementioned regulations that allow (Sec. 20):

    • A minor to be employed between 12 and 5 AM; or

    • A minor to be employed in, about, or in connection with an occupation hazardous to the minor's health or personal well-being.

  • Specifies that the provisions of this bill shall take effect immediately upon passage and approval by the governor (Sec. 20).
