Vote to pass a bill that prohibits the sale of certain diet pills and dietary supplements for weight loss or muscle building to persons under 18 years of age under certain circumstances in New Jersey.

Highlights:

• Prohibits the sale of over-the-counter (OTC) dietary supplements for weight loss or muscle building to individuals under 18 years of age unless accompanied by a parent or legal guardian (Sec. 1).

• Specifies that these prohibitions do not apply to products prescribed by a licensed health care professional (Sec. 1).

• Requires a state court, when determining whether an over-the-counter diet pill or dietary supplement is labeled, marketed, or otherwise represented to achieve weight loss or muscle building in a  summary proceeding before a municipal court having jurisdiction, the court shall consider the following factors, including, but not limited to (Sec. 1):

• Whether the product contains an ingredient approved by the FDA for weight loss or muscle building;

• A steroid, or creatine, green tea extract, raspberry ketone, garcinia cambogia, or green coffee bean extract; or

• Whether the product’s labeling or marketing bears statements or images that express or imply that the product will help:

• Modify, maintain, or reduce body weight, fat, appetite, overall metabolism, or the process by which nutrients are metabolized; or

• Maintain or increase muscle or strength, whether the product or its ingredients are otherwise represented to achieve weight loss or build muscle.

• Specifies that the provisions of this bill shall become effective 6 months following passage and approval by the Governor (Sec. 4).
