Title: Expand Pesticide Regulations Near Schools

Vote to concur with Senate amendments and pass a bill that expands pesticide regulation near schools in California.

Highlights:

  • Establishes accurate enforcement of Sections 6690 -6692 of Title 3 of the California Code of Regulation, the department shall do all the following (Sec. 1): 

    • Requires unique identification number for agricultural field within at least ¼ mile of school site; 

    • Requires any permit application for agricultural use of restricted pesticide to specify an anticipated method for pesticide use for any field within ¼ of the school site; 

    • Authorization of the used of restricted pesticides within ¼ of the school site requires reporting the following: 

      • The specific method of applying the pesticide; and

      • Permitted dates and times of the period during which the pesticide is applied. 

    • For pesticide use reporting form and procedure require reporting the following: 

      • The specific method of applying the pesticide; and

      • Permitted dates and times of the period during which the pesticide is applied.  

  • Requires the director to evaluate the county’s effectiveness in enforcing Sections 6690-6692 of Title 3 of the California Code of Regulations (Sec. 1). 

  • Requires revisions of Sections 6690-6692 of Title 3 of the California Code of Regulations to be adopted by December 31, 2026, and extends adoption to private schools serving K-12 (Sec. 1). 

    • Requires commissioners to use the State Department of Education website to determine the location of k-12 private schools; and

    • Exempt liability from operators or applicators should information gathered from specified sources above be inaccurate.

  • Exempts instances of homeschooling from bill (Sec. 1).
