Vote to concur with Senate amendments and pass a bill that authorizes the retail preparation, sale, and consumption of non-cannabis food and drinks at "cannabis cafes" where patrons are consuming legal cannabis on-site in California.

Highlights:

• Specifies that this bill does not affect local jurisdictions ability to regulate businesses licensed under this division (Sec. 1).

• Authorizes for the issuing of a temporary event license to authorize onsite cannabis sales and consumption by persons 21 or older as long as the following conditions are met (Sec. 1):

• All participants engaged in onsite retail sale of cannabis products at the event are licensed;

• All activities are consistent with regulations from the department regarding state temporary event licenses; and

• 60 days before the event the licensee must provide the department a list of all licensees who will be participating in onsite sales of cannabis products at the event.

• Requires the smoking of cannabis and cannabis products at temporary events to be confined to areas where smoking is not prohibited (Sec. 1).

• Requires those issues a temporary event license to upon completion of the event to return all unsold inventory of cannabis and cannabis products to the licensee retail premises (Sec. 1).

• Requires the inventory of cannabis or cannabis products to be transported to temporary events only by the licensed distributor or micro business (Sec. 1).

• Prohibits the denial of a temporary license for cannabis sale or any disciplinary action on the grounds that the vendor also has an alcohol license (Sec. 1).

• Authorizes for the smoking, vaporizing, or ingestion of cannabis and cannabis products, the preparation or sale of non cannabis food or beverage, and live musical and other performances as long as the following conditions are met (Sec. 1):

• Access to the area where cannabis may be consumed is restricted to people age 21 and older with a warning that cannabis consumption, including smoking, is placed at the entrance;

• Cannabis consumption is not visible from public areas or nonage-restricted areas;

• The sale or consumption of alcohol or tobacco is not allowed on the premises;

• Non-Cannabis food or beverage production are not contaminated or commingled with any cannabis products being sold or served on the premises;

• Smoking or vaporizing of any cannabis product is not allowed in the food preparation, storage, or ware washing area of food facilities located on the premises.

• Requires ventilation and filtration systems if they will prevent smoke and odors from migrating to other parts of the premises (Sec. 1).

• Authorizes employees to wear a mask in any area where cannabis is smoked (Sec. 1).

• Requires employees who will be working where cannabis is smoked to be provided the department of Public Health's guidance regarding secondhand cannabis smoke (Sec. 1).

• Requires second hand smoke be included in a businesses analysis for potential work hazards (Sec. 1).
