Title: Requires Students Use Restrooms that Align with Their Biological Sex and Prohibits Transgender Students from Playing on Female Sports Teams
Vote to pass a bill that requires students use restrooms that align with their biological sex and prohibits transgender students from playing on female sports teams.
Requires all interscholastic or intramural athletic teams or sports leagues sponsored by a state public school to be defined as one of the following based on biological sex, including (Sec. 1):
Males, men, or boys;
Females, women, or girls; or
Coed or mixed.
Requires that students use restrooms that align with their biological sex in all k-12 public schools (Sec. 2).
Prohibits transgender students from playing on female sports teams for any k-12 public school in Nebraska (Sec. 2).
Prohibits any government entity, licensing or accrediting organization, or any athletic association or organization from the following, including (Sec. 5):
Entertaining a complaint;
Open an investigation, or
Take any other adverse action against a school for maintaining separate interscholastic or intramural athletic teams or sports for biological female students.
Specifies that any student who is deprived of an athletic opportunity or suffers any direct or indirect harm as a result of a public school knowingly violating the Sports and Spaces Act shall have a private cause of action for injunctive relief, damages, and any other remedy available by law against the school (Sec. 6).
Authorizes the provisions of this bill to apply retroactively and take effect beginning August 1, 2023 (Sec. 8).
