Highlights:

• Defines alternative nicotine product as a product that contains nicotine but does not contain tobacco and is a product meant to be ingested (Sec. 1).

• Specifies that the preceding definition does not apply to vapor products (Sec. 1).

• Defines vapor product as a product that has an electronic circuit or battery that still contains nicotine (Sec. 1).

• Prohibits individuals under the age of 18 from producing vapor products as well as adults over the age of 18 purchasing these products for minors (Sec. 1).

• Requires a sign stating that people 18 and over will need proof of age to purchase vapor products or alternative nicotine products to be posted in stores (Sec. 1).

• Specifies that failure to post the sign will result in a $25 fine the first time and a $75 fine every time after (Sec. 1).

• Requires the manufacturer to submit a Timely Filed Premarket Tobacco Product Application to be reviewed and approved by the FDA (Sec. 2).

• Requires the secretary to have a list of all certified vapor and alternative nicotine products that can be sold to be available on their website, which is to be updated monthly (Sec. 2).

• Specifies that retailers are subject to unannounced compliance checks and that those results will be published online if requested (Sec. 2).
