Vote to pass a bill that authorizes courts to place a restraining order of up to 2 years on individuals who commit theft, vandalism, and battery in a retail store and considers whether the individual lives in a food desert

Highlights:

• Requires a court to consider issuing a restraining order when an individual is found guilty of crimes related to retail theft that can be deemed valid for up to 2 years (Sec. 2).

• Specifies that a restraining order may be applicable in the following cases (Sec. 2):

• Shoplifting;

• Theft and Organized Retail Theft;

• Vandalism; and

• Assault or Battery of an employee of a store that is actively working

• Specifies that if the crime is committed at a retail chain store, the restraining order could cover other locations of that store within a certain radius (Sec. 2).

• Requires courts to consider whether the retail store that is subject of a crime is the only place that sells food and basic necessities within a mile of where the individual lives (Sec. 2).

• Requires the Department of Justice to maintain a Protective Orders System and grant data access to law enforcement about restraining orders (Sec. 1).

• Specifies that electronic transmission is included in the CLETS system with regards to computer access (Sec. 1). 

• Defines CLETS as California Law Enforcement Telecommunications System, which enters and transmits data to the local agency and court if applicable (Sec. 1).
