Title: Establishes Regulations Regarding the Distribution and Sale of Hemp Products
Vote to pass a bill that establishes regulations on the production and selling of hemp infused products in New Jersey.
Defines hemp product as a finished product with no more than 0.5 milligrams of THC per serving and 2.5 milligrams of THC within the entire package of a hemp product (Sec. 3).
Defines hemp as the plant of Cannabis sativa L., and within that definition, it includes all parts of the plant with a 0.3% dry weight basis (Sec. 3).
Specifies that a cannabis item also includes intoxicating hemp products as part of its definition (Sec. 3).
Specifies that an impact zone is noted as a municipality that has been subject to criminal marijuana enterprises and increased levels of poverty and crime with the following criteria: (Sec. 3).
A population of at least 120,000 people
Ranks within the top 40% of marijuana crime levels and an unemployment rank in the top 15% of municipalities
The municipality is located in a third class county
Defines intoxicating hemp product as a product with at least 0.5 milligrams of THC per serving and 2.5 milligrams of THC in a package (Sec. 3).
Prohibits an individual from distributing intoxicating hemp unless they have a valid license from the Cannabis Regulatory Commission (Sec. 5).
Specifies that the licensing requirements for selling hemp products and who can purchase them also applies to any sales done online (Sec. 5).
Requires any tax revenue made from the sale of intoxicating hemp products to be placed in a nonlapsing fund (Sec. 41).
Specifies that any individual who sells a hemp product not deriving from naturally occurring chemical makeups to receive a fine of at least $100 for their initial violation and up to $10,000 for a third violation (Sec. 41).
