Title: Amends Correction Law in Relation to Incarcerated Parents

Vote to pass a bill that amends corrections law in relation to incarcerated parents in New York.

Highlights:

  • Alleges support for the rights and care of pregnant and postpartum people who are incarcerated (Sec. 1). 

  • Requires incarcerated people to be given comprehensive prenatal care and perinatal care that can includes the following (Sec. 1):  

    • Obstetric care; 

    • Medical care during labor and delivery; 

    • Screening for opioid usage; 

    • Screening for HIV; 

    • Access to vaccines;

    • Appropriate hydration and nutrition 

    • Safe and appropriate housing and living conditions: 

    • Access to exercise facilities;

    • Prevention of exposure to substances and chemicals;and 

    • Other measures 

  • Specifies that a child may be removed from an detention facility and from its birth parent when it is clear that the facility presents a danger to the child (Sec. 1)

  • Specifies that no child shall be removed from the prison nursery without the express oral and written consent of the birthing parent or a finding,  by  clear and  convincing evidence, that such person poses an imminent risk to the health and safety of the child (Sec. 1). 

  • Specifies that the department of corrections shall propose regulations regarding the implementation of these policies within 180s of its passage (Sec. 1).
