Title: Amends Correction Law in Relation to Incarcerated Parents
Vote to pass a bill that amends corrections law in relation to incarcerated parents in New York.
Alleges support for the rights and care of pregnant and postpartum people who are incarcerated (Sec. 1).
Requires incarcerated people to be given comprehensive prenatal care and perinatal care that can includes the following (Sec. 1):
Obstetric care;
Medical care during labor and delivery;
Screening for opioid usage;
Screening for HIV;
Access to vaccines;
Appropriate hydration and nutrition
Safe and appropriate housing and living conditions:
Access to exercise facilities;
Prevention of exposure to substances and chemicals;and
Other measures
Specifies that a child may be removed from an detention facility and from its birth parent when it is clear that the facility presents a danger to the child (Sec. 1)
Specifies that no child shall be removed from the prison nursery without the express oral and written consent of the birthing parent or a finding, by clear and convincing evidence, that such person poses an imminent risk to the health and safety of the child (Sec. 1).
Specifies that the department of corrections shall propose regulations regarding the implementation of these policies within 180s of its passage (Sec. 1).
