Vote to amend and pass a bill that amends definition and titles regarding child pornography to child sexual abuse material in Pennsylvania.

Highlights:

• Defines child pornography as having the same meaning as child sexual abuse material of minors being depicted in an obscene manner and depicted in material that compels abusers to engage in sex acts (Sec. 2).

• Defines sexual abuse as also encompassing the definition of sexual activities that occur between an individual who is 23 or younger and an adult and is filing based on forcible compulsion (Sec. 3).

• Requires internet service providers to disable access to child sexual abuse material within five days of notification from the attorney general (Sec. 3).

• Requires an additional filing period of two years to be granted to any individuals who were victims of sexual abuse when they were under the age of 18 (Sec. 3).

• Specifies that exceptions to sovereign immunity and governmental immunity are applicable when the conduct is deemed to fall under the offenses mentioned in the bill and the plaintiff’s injuries are caused by actions of the commonwealth party (Sec. 3).

• Defines an eligible offender as an individual convicted of a crime who has not been found guilty of violating the following provisions in the United States (Sec. 5):

• Crimes related to incest;

• Crimes related to open lewdness and child sexual abuse material; or

• Crimes that require an individual to register as a sex offender.
