Vote to pass a bill that amends state firearms statutes, including redefining firearms to be in line with the definition outlined in the federal criminal background law.

Highlights:

• Defines firearm as a weapon where a shot is designed to or can quickly discharge explosives regardless of whether the weapon is loaded and operable (Sec. 1).

• Defines projectile weapon as a weapon that can discharge a spear, arrow, crossbow bolt, or any pellet that is bigger than .177 caliber (Sec. 1).

• Specifies that the types of weapons included in the definition are an airgun, crossbow, and an airbow (Sec. 1). 

• Defines antique firearm as a weapon designed prior to 1898 that uses fixed ammunition and is not restored to its usage (Sec. 8).

• Authorizes purposely aiming a firearm or projectile weapon at a vehicle with an individual believed to be in it or an individual not in a vehicle is noted as deadly force (Sec. 2).

• Authorizes the board to communicate rules about carrying both firearms and projectile weapons and create the standards for those authorized to carry the weapons (Sec. 24).

• Specifies that the categories for offenses committed with a firearm or a projectile weapon would receive the appropriate felony classification, depending on the time when the crime was committed (Sec. 3).

• Specifies that anyone dealing with a dangerous weapon illegally can be subject to a Class E or G felony as well as an unclassified misdemeanor (Sec. 5).

• Prohibits convicted felons, those involuntary committed to a treatment center for matters related to mental illness, and juveniles deemed to be mentally unfit to undergo the trial process cannot purchase any type of firearm (Sec. 8).

• Specifies that this provision stays in place unless the individual can demonstrate a shift in demeanor and be in a clear mental state (Sec. 8).

• Amends Titles in Delaware relating to legal proceedings and whether the revised definitions of a firearm are applicable to the situation (Sec. 24).
