Highlights:

  • Specifies that an individual eligible for restricted driving privileges under subparagraph (B) will be subject to the terms under subparagraph (B) for suspension of driving privileges and license (K.S.A. 8-2110).

  • Requires an individual with approved restricted driving privileges to be restricted to only the following circumstances, including: (K.S.A. 8-2110):

    • Driving to or from the individual’s place of employment or schooling;

    • During the course of employment;

    • Driving to or from an appointment with a healthcare provider or during a medical emergency;

    • Driving to or from any place the individual is required to go by a court; and

    • Driving to pick up or drop off children from school or child care.

  • Prohibits an individual from qualifying for restricted driving privileges if they have been convicted for driving with a canceled, suspended, or revoked license over 3 times or if they are suspended for other reasons than failure to comply with a traffic citation (K.S.A. 8-2110).

  • Limits the effect of restricted driving privileges to the lesser of time of the following, including (K.S.A. 8-2110):

    • 60 days from the date that the division of vehicles mails notice to the individual;

    • When the individual enters an agreement with the court regarding failure to comply; or

    • The recission of restricted driving privileges by the division of vehicles.

  • Requires the division of vehicles to rescind restricted driving privileges for an individual suspended for other reasons than failure to comply with a traffic citation or a violation of restrictions at least 2 times (K.S.A. 8-2110).

  • Authorizes an individual with driving privileges revoked solely for driving on a highway with a canceled, suspended, or revoked license to apply for restricted driving privileges, unless they are suspended for other reasons than failure to comply with a traffic citation or a violation of restrictions at least 3 times. These restrictions will last for the lesser of the following, including (K.S.A. 8-2110):

    • The remainder of the period of time that the driving privileges are revoked; or

    • 3 years from the date of approval for the restricted driving privileges.

  • Authorizes an individual with their driving privileges restricted to drive to pick up or drop off children from school or child care (K.S.A. 8-2110).

  • Requires the clerk of a district court and the clerk of a municipal court to make forms available for any individual who seeks to motion the court to waive or reduce traffic fines, court costs, or reinstatement fees (K.S.A. 8-2110).
