Title: Prohibits Municipalities from Requiring Individuals From Homeowners Associations or Mandate Certain Aesthetic Features
Vote to pass a bill that prohibits municipalities from forcing individuals to form homeowners associations or from mandating certain aesthetic features and amenities requiring HOA maintenance in Arizona.
Specifies that municipalities may not interfere with a home buyer's right to choose the features, amenities, structures, floor plans and the exterior design of the house (Sec. 1).
Specifies that a municipality may not require the following (Sec. 1):
Homeowners Associations;
Features that would require and HOA;
Screening, walls, and faces;and
Private streets and roads.
Alleges that Arizona citizens have the right to private property according to the legislature (Sec. 1).
Specifies that a municipality may not adopt the following codes and ordinances that do the following (Sec. 1):
New developments more than 5 acres;
Maximum square footage for a single family home;
Maximum and minimum lot coverage for single-family homes and other structures; and
Design, architectural, or aesthetic elements in a historically designated area.
