Highlights:

• Prohibits the Secretaries of the Interior and Agriculture from restricting the activities of U.S. Customs and Border Protection on Federal lands under his or her jurisdiction and located within 100 miles of an international border (Sec. 1401).

• Authorizes U.S. Customs and Border Protection to conduct the following activities on federal land under the jurisdiction of the Secretaries of Interior and Agriculture (Sec. 1401):
• Construction and maintenance of roads and fences;
• Use of vehicles to patrol;
• Installation, maintenance, and operation of surveillance equipment and sensors;
• Use of aircraft; and
• Deployment of temporary tactical infrastructure, including forward operating bases.

• Specifies that U.S. Customs and Border protection is exempt from certain laws including, but not limited to, the following (Sec. 1401):
• The Wilderness Act;
• The National Environmental Policy Act of 1969;
• The Endangered Species Act of 1973;
• The National Historic Preservation Act; and
• The Wild and Scenic Rivers Act.

• Prohibits U.S. Customs and Border protection from construing the Act to accomplish any of the following (Sec. 1401):
• Restrict use of the land for legally recognized recreational purposes such as hunting, or mining;
• Restrict legal access to the designated land; or
• Allow access to private or State-owned land not designated in the Act.

• Prohibits the provisions of this section from superseding, replacing, or negating treaties or agreements between the United States and Indian tribes (Sec. 1401).

• Specifies that the Act will have no force or effect at the end of the 5 year period following its enactment (Sec. 1401).
